By accessing or using Optimate's services, you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access our service.

2. Description of Service

Optimate provides an AI workflow automation platform that allows users to create, monitor, and optimize AI agents and workflows for various business processes including marketing, sales, customer support, and finance.

3. User Accounts

• You must provide accurate and complete information when creating an account
• You are responsible for maintaining the confidentiality of your account credentials
• You must notify us immediately of any unauthorized use of your account
• One person or legal entity may not maintain more than one free account

4. Subscription and Payment Terms

4.1 Pricing Plans

• Starter Plan: €48/month or €552/year (VAT included)
• Pro Plan: €193/month or €1,668/year (VAT included)
• Free Trial: 10-day free trial available for both plans
• VAT: All prices include Danish VAT (25%) where applicable

4.2 Payment Terms

• Payment: Subscription fees are billed in advance on a monthly or annual basis
• Free Trial: No payment required during 10-day trial period
• Refunds: 30-day money-back guarantee for annual subscriptions
• Price Changes: We reserve the right to modify pricing with 30 days notice
• Automatic Renewal: Subscriptions automatically renew unless cancelled
• Cancellation: Cancel anytime during or after trial period

5. Acceptable Use

You agree not to use Optimate to:

• Violate any applicable laws or regulations
• Infringe on intellectual property rights
• Transmit harmful, offensive, or illegal content
• Attempt to gain unauthorized access to our systems
• Use the service for competitive analysis or to build competing products
• Generate spam, fraudulent, or misleading content

6. Data and Privacy

Your privacy is important to us. Please review our Privacy Policy, which also governs your use of the service, to understand our practices regarding your personal data.

7. Intellectual Property

• Optimate retains all rights to the platform and its technology
• You retain ownership of your data and content
• You grant us a license to use your data to provide and improve our services
• AI-generated content belongs to you, subject to these terms

8. Service Availability

• We strive for 99.9% uptime but cannot guarantee uninterrupted service
• Planned maintenance will be announced in advance when possible
• We are not liable for damages caused by service interruptions

9. Limitation of Liability

To the maximum extent permitted by Danish law, Optimate shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill.

10. Termination

• You may cancel your subscription at any time
• We may terminate accounts that violate these terms
• Upon termination, your data will be retained for 30 days for recovery purposes
• Paid subscriptions continue until the end of the billing period

11. Governing Law

These Terms are governed by the laws of Denmark. Any disputes will be resolved in the courts of Aarhus, Denmark.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes via email or platform notification at least 30 days before they take effect.
